Terms of Service

These Terms of Service (the “Terms”) are between you and Sendar INC (“Sendar”, “we,” “us,” or “our” as applicable), concerning your use of (including any access to) the Services, as defined below and including the Website and other Sendar Materials.
By registering with Sendar, or by using the Services, you agree to be bound by these Terms and consent to receive communications related to the Services in electronic format (as set forth in our Electronic Disclosure Policy available at: https://www.sendar.ai/electronics-policy), and you affirm that you are at least eighteen (18) years of age and legally capable of entering into these Terms. You also agree to comply with our Privacy Policy available at: https://www.sendar.ai/privacy-policy, which is incorporated into these Terms.
1. About Sendar
1.1. Sendar is a technology company incorporated in Delaware. Sendar does not hold customer deposits, issue bank accounts independently, or provide investment, brokerage, or securities services. All banking, payment processing, fund holding, and money transmission services available through Sendar are delivered exclusively in partnership with meCash, Sendar's licensed banking and payments partner.
meCash operates through licensed and regulated financial institutions across the following jurisdictions: Nigeria — International Money Transfer Operator (IMTO) licence, Central Bank of Nigeria (Ref: TED/PFO/CON/PRC/002/142); Rwanda — Payment Service Provider (PSP) licence, National Bank of Rwanda, under Oxford 19 Limited (Ref: 121379921); United States — Registered Money Service Business, FinCEN (Ref: 31000280238771), and Money Transmitter licence in Delaware; Canada — Money Service Business licence, FINTRAC (Ref: C100000503); United Kingdom — registered PSD agent of E27 Partners UK, authorised by the Financial Conduct Authority (FRN: 911527).
Customer funds are held, settled, and safeguarded by meCash in accordance with applicable regulatory requirements — not by Sendar. By using Sendar's payment services, you agree to be additionally bound by meCash's applicable terms and policies, which govern the banking and payment infrastructure underlying the Services.
1.2. The Services enable you to fund a meCash-powered account, hold balances, convert funds into Local Currency, and transmit money to recipients located abroad as part of a single transaction (a “Transfer”). Sendar only facilitates Transfers to certain countries. We reserve full discretion to refuse to accept any user or complete any Transfer instruction.
2. Glossary
Business Day – A day other than Saturday, Sunday, or a U.S. public holiday when financial institutions are open.
meCash – Sendar's licensed banking and payments partner, responsible for holding customer funds, issuing linked accounts, processing payments, and enabling cross-border transfers across all supported jurisdictions.
meCash Account – A regulated account issued or managed by meCash on your behalf, accessible through the Sendar platform, which may hold balances in one or more currencies.
Sendar Materials – Any software, data, content, and documentation developed by us or our affiliates, or available for download from our Website.
Local Currency – The applicable local currency in the countries where Sendar allows Transfers.
Services – All products, services, features, technologies, functions, and related websites, applications, and services offered by Sendar in partnership with meCash.
Unauthorized Transaction – A Transfer made from your WhatsApp account using Sendar that you did not authorize and that did not benefit you.
Website – Any webpage at https://www.sendar.ai or our WhatsApp platform.
3. Using Our Services
3.1 Onboarding
All Services are provided through your WhatsApp account. You must sign up for Sendar, link your WhatsApp account, and provide accurate and truthful information. As part of onboarding, meCash will provision a regulated account on your behalf to enable fund holding, payment processing, and cross-border transfers. You are responsible for keeping your contact and account information up-to-date. We may refuse or discontinue Services at any time.
All activity under your account is your responsibility. You must only transact for yourself. Duplicate accounts may be merged or closed.
3.2 User Security
You, not Sendar, are responsible for maintaining security of your IDs, passwords, and WhatsApp login. Never disclose your credentials. If compromised, change them immediately and contact us at contact@sendar.ai or call us at the number provided in Section 15. We may suspend your use if we detect suspicious activity.
3.3 Authorizing Third Parties
You may authorize third parties to initiate Transfers. We are not responsible for their use of your account. Your responsibilities under these Terms remain.
3.4 Verification
Applicable law and meCash's regulatory obligations require us to verify your identity before you can access the full range of Services. You authorize us and meCash to make inquiries, including checking identity databases or credit references, and to request documentation such as your government-issued ID, passport, or proof of address. We may close or limit your account if we cannot verify your information to the satisfaction of meCash's compliance requirements.
4. Our Services
4.1 Funding Your Account
You may add funds to your meCash Account through methods supported by meCash's payment infrastructure in your jurisdiction, including linked bank account debit, bank transfer (ACH push or local equivalent), or other methods we make available. All funding methods are provided through meCash's regulated platform. We may change or discontinue supported funding methods at any time.
4.1.1 Linked Bank Account Funding via meCash
If you choose to fund your account by linking a bank account, you will connect your bank directly through meCash's secure payment platform. By providing your bank details and authorizing a funding transaction, you confirm that:
- The account details provided are accurate and complete
- You are the authorized holder of the linked bank account
- Your bank account is in good standing
- You have the authority to initiate electronic fund transfers from the account in the specified amount
When you authorize a funding transaction, you permit meCash to initiate electronic debits or credits on your behalf — including any applicable fees — until cancelled in accordance with these Terms.
If a funding transaction is returned, reversed, or subject to a chargeback by your bank, you authorize Sendar and meCash to recover the full amount plus any associated fees from future transactions, your meCash Account balance, or other methods available to us. If unpaid liabilities remain unresolved, we may suspend or close your Sendar account.
4.1.2 Bank Transfer (ACH Push or Local Equivalent)
You may fund your meCash Account by initiating a bank transfer from your own bank to your meCash-assigned account details. Funds will be credited to your account once the transfer has fully cleared. If cancelled before clearing, funds will be returned to the originating bank account. Transfer timelines vary by jurisdiction and banking partner.
4.1.3 Other Information
We do not accept cash, mailed checks, or credit cards as funding methods. Wire transfers may be supported in select jurisdictions — contact us for details. Transaction and holding limits may apply and are determined by meCash in line with applicable regulatory requirements.
4.2 Holding Funds — meCash Account Balance
Through Sendar, you may hold a balance in your meCash Account in local or supported foreign currency before initiating a Transfer or after receiving a refund. Funds held in your meCash Account are safeguarded by meCash in accordance with applicable regulatory requirements, including segregation from meCash's own funds where required by law.
Sendar does not own, control, or have access to funds held in your meCash Account. To withdraw held funds or close your meCash Account, you must follow the applicable procedures set out in meCash's terms. Interest is not paid on balances held in your meCash Account unless otherwise stated.
4.3 Sending Money — Transfers
Once your meCash Account is funded, you may initiate a Transfer via WhatsApp. Sendar will present you with the applicable exchange rate and any fees before you confirm the Transfer. meCash executes the Transfer on your behalf through its licensed payment network in the destination jurisdiction.
4.4 Currency Conversion
A Conversion Fee may apply as set out in our Fee Schedule (https://www.sendar.ai/fee-schedule). Promotional rates may apply from time to time. We will inform you of the applicable exchange rate and total cost before you confirm your Transfer.
4.4.1 Exchange Rates
Exchange rates are sourced from meCash and reference market providers and may change without prior notice. The rate displayed at confirmation is the rate applied to your Transfer.
5. Cancellation of a Transfer
5.1 Personal, Family, or Household Transfers
You may cancel within thirty (30) minutes of payment confirmation, provided funds have not yet been picked up or deposited by the recipient. To cancel, message us via WhatsApp, email contact@sendar.ai, or call us. Refunds are returned to your meCash Account balance or originating payment method, depending on the method used.
5.2 Business or Commercial Transfers
You may cancel before completion, provided funds have not been picked up or deposited. Contact us immediately upon deciding to cancel.
5.3 California and Washington Customers
You may cancel before completion for a full refund, unless funds have been picked up or deposited by the recipient.
6. Fees
The fee for a Transfer, including currency conversion, is set out in our Fee Schedule (https://www.sendar.ai/fee-schedule). Fees are processed by meCash and form part of these Terms. The applicable fee schedule may change and you will be notified in advance of material changes.
The Conversion Fee is charged at the time your Transfer is confirmed and processed by meCash. This fee does not include any fees charged by the recipient's bank or local payout partner. You are responsible for any applicable taxes arising from your use of the Services.
7. Transaction Statements and Records
You have the right to receive a statement of your Sendar and meCash Account activity. You may request your statement at any time via WhatsApp or by contacting us. Each Transfer is assigned a Transaction Reference Number, which you should quote in all communications with us regarding that Transfer.
8. Terminating Your Account
8.1 You can close your account
You may terminate these Terms and close your Sendar account at any time by contacting us at contact@sendar.ai or calling the number provided in Section 15. Any balance remaining in your meCash Account will be returned to you in accordance with meCash's withdrawal procedures. You must not close your account to avoid an investigation. You remain responsible for all obligations incurred prior to termination.
8.2 Sendar can terminate your access
We may suspend or terminate these Terms or your access for any reason, including:
- Breach of any provision of these Terms or meCash's applicable terms
- Law enforcement or government request
- Violation of applicable laws or regulations
- Fraudulent or illegal activity
- Use of your account for restricted activities
We may also suspend your access if your WhatsApp account has been compromised or if meCash flags your account for compliance review. You remain responsible for all reversals, chargebacks, and liabilities caused by your breach or misuse.
9. Communications
We communicate primarily via WhatsApp. You must maintain a valid WhatsApp account and check messages regularly. We may also contact you via email (contact@sendar.ai), letter, telephone, or SMS. meCash may contact you directly regarding your meCash Account where required by regulation. Notices are deemed received the same day if sent electronically, or three (3) Business Days if sent by mail.
10. Issues That May Occur
10.1 Reversals and Chargebacks
If a payment you use to fund your account is later refunded, reversed, or invalidated, you are responsible for the full amount plus any fees incurred. This includes:
- Fraudulent funding transactions
- Payments made in error
- Unauthorized funding transactions
- Transactions related to prohibited activities
If your bank or meCash returns a funding transaction, we will reverse the related Transfer and any associated meCash Account credits. You must repay any resulting negative balance immediately.
10.2 Negative Refunds
If we issue a refund after funds have already been delivered to the recipient (“Negative Refund”), you owe us the full amount immediately. We may deduct from future transactions, your meCash Account balance, use collection services, or take legal action to recover the amount.
10.3 Error Resolution
You must ensure that all information provided for a Transfer — including recipient details and amounts — is accurate before confirming. Transfers executed on the basis of incorrect information you provided cannot be reversed except as required by applicable law. Report any suspected errors to us within 180 days of the Transfer date, providing all relevant details including your Transaction Reference Number. We will investigate in coordination with meCash and respond promptly.
11. Errors
11.1 What is considered an Error
For Transfers of $15 or more for personal, family, or household purposes, an “Error” includes:
- Incorrect payment amount debited or credited
- Computational mistakes in the conversion or fee calculation
- Amount not made available to the recipient within the stated timeframe
- Delayed or missing delivery (except delays caused by legal holds, compliance reviews, or recipient-side issues)
- A Transfer missing from your transaction statement
- Failure to provide a confirmation of your Transfer
If we confirm an Error, we will either refund the full amount to your meCash Account or arrange for delivery of the funds as originally intended.
11.2 What is not considered an Error
The following are not considered Errors:
- Giving someone else access to your WhatsApp account or Sendar credentials
- Valid reversals or cancellations made in accordance with these Terms
- Requests for account status or balance inquiries
- Changes requested by the recipient
- Mistakes arising from inaccurate information you provided (e.g., wrong recipient name or account number)
- Delays due to compliance holds, fraud risk reviews, meCash processing times, or actions by third-party payout partners
12. What is Not Considered an Unauthorized Transaction
A Transfer is not “Unauthorized” if you voluntarily gave someone your WhatsApp login or Sendar credentials, even if they exceeded the authority you intended to grant, or if the Transfer was reversed or cancelled in accordance with these Terms.
13. Restricted Activities
13.1 Lawful Use Only
You may use our Services only for lawful purposes. You may not:
- Breach any local, national, or international law or regulation
- Act unlawfully or fraudulently
- Harm or attempt to harm minors
- Use abusive, harmful, or non-compliant content
- Send spam or unauthorized promotional material
- Distribute harmful programs (viruses, spyware, malware, etc.)
- Evade taxes or facilitate tax evasion for yourself or others
- Circumvent meCash's or Sendar's compliance controls or transaction limits
13.1.1 Unsupported Businesses & Transactions
Neither Sendar nor meCash supports businesses or transactions in prohibited categories, including but not limited to: adult content, controlled substances, counterfeit goods, gambling operations, unlicensed financial services, or any activity restricted under applicable sanctions or anti-money-laundering regulations.
14. Protection from Unauthorized Transactions
Sendar and meCash take unauthorized activity seriously and will work with you to investigate and resolve valid reports.
14.1 Reporting
If you suspect unauthorized use of your account, contact us immediately at contact@sendar.ai or by phone. You must report suspected unauthorized Transfers within 60 days of the statement date on which the unauthorized Transfer appears.
14.2 Not Covered
Transactions made by a person to whom you granted account access, or Transfers that were validly reversed or cancelled under these Terms, are not covered under unauthorized transaction protections.

If your complaint relates specifically to your meCash Account, banking services, or regulated payment activities, meCash may need to be involved in the resolution process. We will coordinate with meCash on your behalf.
16. Information Security
You must secure your devices, WhatsApp account, and Sendar credentials. Do not introduce malicious software or attempt unauthorized access to Sendar's or meCash's systems. Any security breach or suspected compromise should be reported to us immediately. Violations may be reported to law enforcement and may result in immediate account suspension.
17. Third-Party Materials
Our Services may reference or link to third-party content, including meCash's own terms and policies. We do not control, endorse, or guarantee third-party materials beyond our partnership with meCash, and your use of any third-party services is at your own risk and subject to their applicable terms.
18. Fraud Prevention
18.1 Account Security
You are solely responsible for keeping your Sendar credentials and WhatsApp account secure and confidential. Never share your PIN, password, or one-time passcodes with anyone, including Sendar or meCash staff.
18.2 Fraud Risk Reviews
Sendar and meCash operate automated and manual fraud detection systems. We may hold, delay, or decline transactions for compliance or fraud risk reasons and may require additional verification before processing.
18.3 Unauthorized Transactions
Defined as Transfers executed through your account without your knowledge or authorization, and from which you received no benefit.
18.4 Consumer Fraud Warnings
Common scams include account takeover fraud, impersonation of Sendar or meCash staff, and social engineering attacks. Sendar and meCash will never ask for your password or one-time passcode. Always verify the identity of anyone requesting your credentials before acting.
18.5 Account Closure & Suspension
We and meCash may close or suspend accounts for breach of these Terms, abusive conduct, security concerns, suspected unauthorized use, or fraud. Where permitted by law, we will notify you of the reason.
18.6 Compliance with Laws
You agree to comply with all applicable laws and regulations, including anti-money-laundering (AML), know-your-customer (KYC), and counter-terrorism financing (CTF) requirements across all jurisdictions where you use the Services.
18.7 Data Privacy
We handle your data in accordance with our Privacy Policy. As our banking partner, meCash may independently process your personal data for regulatory, compliance, and fraud prevention purposes under its own privacy policy. We may share relevant information with meCash, fraud prevention agencies, or law enforcement where required by law or regulation.
18.8 Limitation of Liability
Neither Sendar nor meCash is liable for indirect, consequential, or punitive damages arising from your use of the Services. Our total aggregate liability to you is limited to the lesser of $100 or the direct, proven damages resulting from our actions or omissions.
18.9 Governing Law & Arbitration
Except where inconsistent with applicable mandatory law in your jurisdiction, these Terms are governed by the laws of the State of New York, United States. Disputes that cannot be resolved informally will be submitted to binding individual arbitration under AAA Consumer Arbitration Rules. You waive the right to participate in class-action proceedings.
19. Sendar's Rights
19.1 Limitation on Liability & Indemnity
You agree to indemnify and hold harmless Sendar, meCash, and their respective affiliates, officers, employees, and agents from and against all claims, losses, and expenses (including reasonable legal fees) arising out of your use of the Services, your breach of these Terms, or your violation of any applicable law or regulation.
19.2 Release
If you have a dispute with another user, a recipient, or any third party in connection with the Services, you release Sendar and meCash from any related claims, demands, and damages.
19.3 Service Availability
We do not guarantee uninterrupted or error-free access to the Services. Sendar and meCash may suspend, modify, or discontinue any part of the Services at any time, with or without notice, including for maintenance, regulatory requirements, or commercial reasons.
19.4 Intellectual Property
All rights, title, and interest in the Sendar platform, brand, content, and technology are owned by Sendar or its licensors. Nothing in these Terms grants you any ownership rights in the Services or Sendar Materials.
19.5 Export Controls
You must comply with all applicable U.S. export controls, trade sanctions, and restrictions. You represent that you are not located in, or acting on behalf of any person or entity in, a country subject to U.S. embargo or designated as a state sponsor of terrorism.
19.6 Other Terms
You may not assign your rights or obligations under these Terms to any third party without our prior written consent. These Terms, together with our Privacy Policy and meCash's applicable terms, constitute the entire agreement between you and Sendar with respect to the Services and supersede all prior agreements on the same subject matter.
